Biography

Marius Emberland is professor at the Department of law and governance, specializing in public and international law. His main teaching assignments at BI are with the five-year Master of laws programme, concentrating on the law of civil procedure, constitutional law, and international law, including human rights.

He joined the BI faculty in 2023. He was previously associate professor at the Faculty of law at the University of Oslo, but the decade and a half prior to his moving to BI he worked for the Norwegian Government, first at the Legal Affairs Department at the Ministry of Foreign Affairs, then as attorney for the Norwegian Government at the Office of the Attorney General for Civil Affairs, where he inter alia for ten years served as Norway's Government Agent before the European Court of Human Rights and other international human rights bodies, and finally, prior to called to BI, as chief analyst at the Ministry of Justice and Public Security. He has also served as acting appeals court judge at the Borgarting High Court in Oslo. He is presently part of the editorial committees of two Norwegian law jornals (Lov og rett, and Kritisk Juss), and has formerly had similar roles at the Nordic Journal of International Law and Harvard International Law Journal. He has been editor-in-chief of the Nordic Journal of Human Rights.

Marius has litigated more than a hundred cases on behalf of ministries of the Norwegian Government in domestic courts on a variety of matters, including more than 15 cases before the Supreme Court of Norway. Several of them are seminal judgments in the corpus of the Supreme Court. He has litigated many cases before the European Court of Human Rights, in his capacity of Norway's Agent, and also cases before the European Court of Justice and the EFTA Court. He was part of Norway's legal team in the first BIT arbitration case ever against Norway under ICSID in the case of SIA North Star Ltd. v. Norway in 2020-2023.

Marius has his basic five-year masters of law degree (cand.jur.) from the University of Oslo, and he also holds an LL.M. degree from Harvard Law School. He has a doctorate in law (D.Phil.) from the University of Oxford on a dissertation concerning the protection of companies' and shareholders' interests under the European Convention on Human Rights (published as "The Human Rights of Companies: Exploring the Structure of ECHR Protection" by Oxford University Press).
